Dudensing secured a $3.5 million settlement for a patient in an elder neglect case. The settlement brings justice for the patient and their family and holds the facility accountable for their actions.
In late 2023, the patient was hospitalized after experiencing a fall at home. There, her doctor discovered that she had nerve issues and a toe fracture, affecting her ability to walk. Due to her lack of mobility, she was admitted to a nursing home to assist with her daily living activities to improve her health.
The facility was made aware of the patient’s situation and that she was at high risk of falls. However, they failed to ensure that she was properly monitored, that her bed was safe, and that she had assistance when requiring mobility. As a result of this neglect, the patient fell six times during her time at the facility.
Following one fall, the nursing home did not notice or assess the harm caused. The patient’s daughter first noticed a large bump behind her right ear when visiting her the next day. The following week, when visiting a doctor, the patient was diagnosed with bleeding in the brain, which was not present before her admission to the nursing home.
At the time of her admission, the patient was able to communicate and was fully oriented but after a few months into her stay at the facility, she had deteriorated to the point where she was barely speaking or moving. The trauma to her head was so severe that she fell into a coma and did not wake up for an entire week. Thankfully, she was saved by surgery and able to regain consciousness, but her experiences at the facility severely and irreversibly degraded her physical and mental health.
Elder neglect should not be tolerated, and nursing homes must be held accountable. Dudensing Law’s top priority is to attain justice for patients and their families who were unjustly harmed.
