Dudensing Law secured a $2 million recovery for the family of a man who suffered a preventable death following a period of systemic neglect at a Sacramento residential care facility.
The resident, who suffered from Alzheimer’s dementia, was admitted to the facility for supervision after a hip fracture. During his stay, the resident suffered at least four falls, and because staff failed to monitor his nutritional intake, he lost more than twenty pounds in just a few months.
The facility further ignored specific physician orders for an influenza vaccine and failed to respond to a “raging” infection for days. Even after the resident suffered a seizure and his family repeatedly raised concerns, medical intervention was delayed. He eventually died from Influenza A, an outcome the lawsuit argued was entirely preventable.
