Dudensing Law recently secured a $3.5 million recovery for the family of an elderly woman who suffered severe neglect and abuse during her stay at a California nursing home.
The patient was admitted to the facility for rehabilitation following a fall, with her condition stable and her skin intact upon arrival. In just over a month, however, she developed multiple preventable pressure wounds, including a Stage IV wound to the bone. She also developed infections, including sepsis, pneumonia, and influenza A. The neglect prevented her from participating in therapy, compromised her quality of life, and ultimately contributed to her death.
The facility also failed to provide even basic custodial care, ignored clear signs of medical decline, and falsified documentation to cover up neglect. Corporate operators overseeing the facility were accused of deliberately understaffing in order to maximize profits, despite being aware of repeated complaints and regulatory actions against their facilities.
