$2.75 Million Settlement Secured by Dudensing Law for Patient in Assisted Living Facility Neglect Case

Dudensing Law secured a $2.75 million settlement for the family of an elderly woman who was admitted to, and soon after passed away in, an assisted living facility in California.
The patient was a dedicated supporter and volunteer for various nonprofits in her area and was known for her advocacy for seniors. She was admitted to the facility in early May of 2021 after she had experienced several falls, underwent numerous surgeries, and suffered from dementia and Alzheimer’s, leading her to require consistent care and assistance.
The facility was aware of the patient’s needs and assured her family that she would receive the necessary monitoring and care. However, they failed to do so. The facility’s caregivers were overworked and understaffed and, for a large portion of her stay, the staff left the patient alone in her room.
Just a couple of days into her stay, the patient suffered a devastating fall and lay there for at least two hours before the staff finally found her lying on the floor in her own blood. She was hospitalized, and there they determined that she had suffered a displaced fracture on her left femur, a laceration to the back of her head, brain contusions, and multiple other abrasions from the fall.
She passed away nine days after the fall.
This settlement serves as a reminder that neglect like the kind displayed in this case will not be tolerated and that these facilities must be held accountable for failing to provide proper care. Dudensing Law is dedicated to securing justice for patients of elder abuse and their families.
