Dudensing Law secured a $3.85 million settlement for the family of an elderly woman who suffered under the care of a nursing home and passed away.
In 2023, the patient was admitted to a nursing home after being hospitalized for a stroke. Prior to her hospitalization, she was living independently with her daughter’s assistance. She was admitted to the nursing home for short-term rehabilitation with the plan that she would return to her family. Unfortunately, that did not happen.
The nursing home failed to properly feed the patient. In just three weeks, she lost 27.5 pounds or 14.6% of her body weight, and the nursing home did not notify her physician or family of this significant loss.
In addition, they failed to administer four physician-ordered medications on five of the patient’s last eleven days at the nursing home. This caused the patient to have episodes of uncontrolled hypertension and elevated blood pressure, and eventually, she suffered another stroke. The rapid loss of weight and muscle mass, along with the lack of critical medication, weakened her immune system and organs, making it more difficult for her to recover from her strokes. As a result of lacking care, she also suffered from a UTI and two pressure sores.
Just 28 days after her admission to the nursing home, the patient passed away.
The neglect shown by this facility had devastating consequences. This settlement is a powerful reminder that nursing homes have a legal duty to protect their residents, and failure to do so will not go unchecked.
