In February 2025, Dudensing Law secured a $2 million settlement for the family of an elderly woman after she was admitted to, and later passed away in, a nursing home located in California.
In early February 2023, the patient was admitted to the nursing home following a hospital admission for a minor stroke. Prior to her hospitalization, she was living independently with the assistance of family and had a good quality of life. She was admitted for short-term rehabilitation with the plan that she would return to the community following a brief admission at the nursing home. However, that plan did not come to fruition.
The nursing home facility dangerously neglected the patient’s needs by failing to feed her properly, keep her hydrated, prevent severe bedsores, and protect her from the flu. The patient lost an astounding 47.2 pounds, or 23.5% of her body weight, between January and March of 2024.
She experienced several documented wounds that appeared to be “related to trauma” but were never investigated by the nursing home. Notably, the patient was documented as receiving only one shower during a period of several weeks.
She passed away following a brief, three-month stay at the facility.
This type of treatment represents a severe breach of care standards that nursing homes are legally required to maintain. The settlement reflects the egregious nature of the neglect the patient suffered and serves as a reminder that elder abuse in care facilities will not be tolerated.
